This Privacy Policy explains how Humergy, Inc. (“Humergy,” “we,” “us,” or “our”) collects, uses, discloses, and protects personal information when you visit www.humergy.com, create an account, enroll in a membership, request or receive fuel-delivery services, communicate with us, or otherwise use our services.

2. INFORMATION WE COLLECT
We collect only information reasonably needed to operate, protect, and improve our services. Depending on how you interact with Humergy, this may include:
• Account and contact information, such as name, email address, telephone number, account credentials, and communication preferences.
• Membership and transaction information, such as selected plan, pricing version, billing status, invoices, refunds, cancellation records, gallons delivered, fuel grade, and delivery history.
• Vehicle information, such as make, model, color, license-plate or tag information, fuel grade, and other information required to identify and safely service an enrolled vehicle.
• Service-location and scheduling information, such as a home, workplace, or other authorized delivery address, access instructions, preferred service times, and property-access permissions.
• Payment information. Payment-card and wallet credentials are processed by Wix and applicable payment providers. Humergy receives transaction status and limited billing details but does not intentionally store complete payment-card numbers.
• Delivery-confirmation and safety information, such as service records, metered fuel quantity, photographs documenting completion, incident reports, and customer-support records.
• Communications, including emails, contact-form submissions, telephone or chat communications, survey responses, and preferences for transactional or optional marketing messages.
• Website, cookie, device, and analytics information, such as IP address, browser and device type, pages viewed, referral source, approximate location derived from IP address, cookie identifiers, and interaction data.
Humergy does not require a customer’s date of birth to enroll in a Delivery membership. Please do not provide sensitive personal information that we have not requested.
3. HOW WE COLLECT INFORMATION
We collect information directly from you, automatically through our website and related technologies, from transactions and delivery activity, and from service providers that help us operate the website, process payments, communicate with customers, prevent fraud, and provide services.
4. HOW WE USE INFORMATION
We use personal information to:
• Create and administer accounts and memberships.
• Confirm eligibility, identify vehicles, schedule and complete deliveries, and provide service confirmation.
• Calculate, disclose, process, and document membership, fuel, service-premium, tax, and other authorized amounts.
• Process payments, refunds, cancellations, and customer-service requests.
• Send operational messages about enrollment, pricing, appointments, deliveries, billing, safety, account security, and policy changes.
• Send marketing communications only when permitted and honor unsubscribe choices.
• Maintain safety, security, fraud prevention, quality assurance, records, analytics, and business continuity.
• Improve our website, services, scheduling, routing, customer experience, and accessibility.
• Comply with applicable law, insurance requirements, legal process, and enforceable agreements.
5. HOW WE DISCLOSE INFORMATION
We may disclose personal information only as reasonably necessary for the purposes described in this Policy, including to:
• Wix and website-hosting, account, form, analytics, and infrastructure providers.
• Payment processors, financial institutions, fraud-prevention providers, and billing or accounting providers.
• Delivery, routing, communications, customer-support, technology, professional, insurance, and operational service providers acting for Humergy.
• A property owner, employer, parking operator, or other responsible party when needed to confirm authorized access, without disclosing unrelated account information.
• Government agencies, regulators, courts, law enforcement, insurers, or other parties when required or permitted by law, necessary to protect safety or legal rights, or needed to respond to legal process.
• A successor or participant in a merger, financing, acquisition, reorganization, bankruptcy, or transfer of business assets, subject to applicable confidentiality and legal requirements.
Service providers may use information only to provide contracted services or as otherwise permitted by law. Humergy does not sell personal information. Humergy does not share personal information for cross-context behavioral advertising.
6. COOKIES AND ANALYTICS
Our website and service providers may use necessary cookies and similar technologies for security, account access, shopping-cart and checkout functions, preferences, performance, and analytics. Where required, we request consent before using nonessential technologies. Browser or device controls may allow you to reject or delete cookies, although some site functions may not work correctly without necessary cookies.
7. MARKETING CHOICES
Transactional communications are necessary to administer accounts, memberships, deliveries, billing, safety, and security. Marketing messages are optional. You may unsubscribe using the link in an email or by contacting here@humergy.com. Unsubscribing from marketing does not stop necessary transactional communications.
8. DELIVERY PHOTOGRAPHS AND LOCATION INFORMATION
Humergy may create a photograph or similar record to document a completed delivery, vehicle identification, meter reading, fuel-door condition, safety issue, or authorized service location. We use these records for confirmation, customer support, safety, dispute resolution, fraud prevention, insurance, and legal compliance. We do not use delivery photographs for advertising without separate permission.
Humergy uses service-location information to schedule, route, and perform requested services. We do not continuously track a customer or vehicle through this website unless a separate feature clearly explains that collection and obtains any consent required by law.
9. DATA RETENTION
We retain personal information only for as long as reasonably necessary to provide services, maintain transaction and safety records, resolve disputes, enforce agreements, meet accounting, tax, insurance, and legal obligations, and protect our systems. Retention periods vary by record type. When information is no longer reasonably needed, we delete, deidentify, or securely dispose of it, subject to backup and legal-retention requirements.
10. SECURITY
We use reasonable administrative, technical, and physical safeguards designed to protect personal information. No transmission or storage system is completely secure, and we cannot guarantee absolute security. You are responsible for protecting account credentials and promptly notifying us of suspected unauthorized access.
11. YOUR PRIVACY REQUESTS
You may ask to access, correct, or delete personal information associated with you, or request information about how it is used or disclosed. You may also withdraw optional marketing consent. Submit a request to here@humergy.com and describe the request sufficiently for us to respond.
We may verify your identity and authority before completing a request. We may retain information when required or permitted by law, including transaction, safety, fraud-prevention, legal, and accounting records. We will respond within the period required by applicable law and will not discriminate against you for exercising an applicable privacy right.
12. CHILDREN’S PRIVACY
Humergy’s membership and fuel-delivery services are intended for adults. We do not knowingly collect personal information from a child under 13 through enrollment. If you believe a child provided personal information, contact here@humergy.com so we can review and take appropriate action.
13. THIRD-PARTY LINKS AND SERVICES
Our website may link to third-party websites or services, including AAA fuel-price information, payment providers, social networks, and other resources. Their privacy practices are governed by their own policies. Humergy is not responsible for a third party’s independent privacy practices.
14. CHANGES TO THIS POLICY
We may update this Privacy Policy prospectively. The updated Policy will show a new effective date. We will provide any additional notice or obtain consent required by applicable law before a material change applies.
